1. Agreement to Terms

By accessing or using our website mozgotech.com and our services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our website or use our services.

2. Services

MozgoTech provides mobile application development, game development, and related design services. The specific scope, deliverables, and timeline for any project will be defined in a separate agreement between MozgoTech and the client.

3. Intellectual Property Rights

Unless otherwise indicated, the website is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the website are owned or controlled by us or our licensors and are protected by copyright and trademark laws.

For custom development projects, intellectual property ownership will be defined in the project agreement. Generally:

• Upon full payment, clients receive ownership of custom-developed code
• MozgoTech retains rights to pre-existing tools, libraries, and frameworks
• Third-party assets remain subject to their respective licenses

4. Client Responsibilities

Clients are responsible for:

• Providing accurate and complete project requirements
• Timely delivery of required materials (content, assets, credentials)
• Designated points of contact for feedback and approvals
• Timely review and approval of project milestones

5. Payment Terms

Payment terms will be outlined in each project agreement. Generally:

• A deposit is required before work begins
• Milestone payments are due upon completion of agreed deliverables
• Final payment is due upon project completion and before source code delivery
• Late payments may incur additional fees as specified in the agreement

6. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the course of the project. This includes business plans, technical specifications, source code, and other sensitive materials.

7. Limitation of Liability

To the maximum extent permitted by law, MozgoTech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

8. Warranty

We warrant that our services will be performed in a professional and workmanlike manner. We provide a 30-day warranty on delivered code to fix any defects related to the original specifications. This warranty does not cover issues arising from:

• Modifications made by parties other than MozgoTech
• Integration with third-party services or APIs
• Changes in third-party platform requirements (iOS, Android updates)

9. Termination

Either party may terminate a project agreement with written notice. In the event of termination:

• Client is responsible for payment of all work completed to date
• Work in progress will be delivered upon receipt of final payment
• Confidentiality obligations survive termination

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on this page. Your continued use of our website after any changes constitutes acceptance of the new Terms.
